These are the terms and conditions which will apply to your purchase of clothing, accessories and other goods (“Goods”) from the Duchamp London web site wwww.duchamplondon.com (the “Website”). This Website and the Goods are provided by Duchamp London Limited , a company registered in England and Wales under number 10222733 with a registered office Hatherley House, 15-17 Wood Street, EN5 4AT (“we”, “us”, “our”). When we refer to “you” and “your” we mean the user of the Website and purchaser of Goods.
By purchasing Goods, you agree to accept the terms and conditions set out from us.
These terms and conditions form a legally binding agreement between us and you and describe the terms and conditions applicable to your use of our website and the services we offer including the sale of Goods to consumers.
We strongly recommend that you read these terms and conditions. You can also access and read any other information contained on other pages or websites referred to in these terms and conditions as they may contain further terms and conditions that apply to you.
We reserve the right to amend these terms and conditions under which the Website and the Goods are provided. Any such change in terms and conditions will be effective to all new orders once included in the text of these terms and conditions and published on the Website. You should review the terms and conditions posted on the Website periodically to ensure that you are aware of and comply with the current version. The www.duchamplondon.com website is provided for a sole personal use. Any other commercial purpose is not allowed.
You may browse and purchase on our website without need to register.
If you only wish to receive our newsletters and seasonal offer notifications you can subscribe entering your details and email address on the CONTACT US page or at the bottom page of the HOME page. In order to record your personal information, create an account with us and receive our newsletters you can choose the REGISTER option.
Any changes to your details can be emailed to us at email@example.com or you can simply notifying us via telephone dialling 0044 (0)333 939 8343.
When you create an account with us you will be able to log into your account history using your email address and password. The password is created by you. If for any reason this password is lost, forgotten or disabled we advise to contact us immediately.
Creating an account with us, you will be given an option to register your card payment details too. This will make all your subsequent purchases faster and hassle-free. Duchamp London will not be able to access to such information and therefore we recommend to report possible misuse or change of such important information as we cannot be liable for any mistake or fraudulent use.
DESCRIPTIONS AND PRODUCT INFORMATION
We will take all reasonable care to ensure that all details, prices, photographic representations and descriptions of products are correct at the time when the relevant information was entered onto the system. However, due to factors such as differences in monitors and screen settings, we are unable to guarantee the following:
• that the colour you will see on your monitor will accurately reflect the colour of the product;
• all sizes and measurements are approximate;
• all Goods are subject to availability- we may not be able to supply your order; and
• any delivery estimates given on the Website or by email are estimates only;

Your Order only constitutes an offer to purchase Goods from us, and does not form a binding contract until accepted by us. Where you order more than one product your Order contains a series of offers for each product individually.
All prices displayed on our website are quoted in GB Pound Sterling. The US dollar section of this website will be showing all prices in US Dollars. Delivery charges may apply and these will be displayed in the order process.
Prices quoted in GB Pound Sterling include a VAT at 20% (UK Tax) and are subject to change if the applicable rate of VAT changes before your order is accepted. VAT Number is 242699577.
Orders placed in GB Pound Sterling and delivered outside of the European Union are subject to a VAT deduction. This will be applied at the checkout stage upon entering a valid delivery address. Your package will be sent DDU (Delivery Duty Unpaid). You will be responsible for paying any local tax or import duties arising at the delivery destination which are not included in the price of the products. Import duty or tax costs will be invoiced directly to you from DPD or any other courier responsible for your delivery. We recommend you contact your local customs authority to determine a landed cost price prior to order completion.
Orders placed in US Dollars (via our US website version) will include all relevant taxes and duties in the prices displayed on our US website. All orders placed via the US website will be sent DDP (Delivery Duty Paid). Therefore no additional charges will be issued against you prior or upon delivery.
All prices are quoted exclusive of postage. The shipping charge will be applied during the checkout process.
Once you have confirmed your order we will issue you with a Duchamp London order reference number which will appear in your order confirmation and will be sent to the email address you have provided. Please ensure that you save this number for any references.
On placing an order with Duchamp London, you are making an offer to us to purchase the product selected in accordance with these terms. Please note that we may not always be able to accept your offer. All orders are subject to availability and ACCEPTANCE.
We may apply from time to time reductions against the normal prices of selected goods or their shipping costs. These offers may be visible on the product pages or applied automatically at the checkout stage of your purchase transaction.
ONLINE GIFT CERTIFICATE
The Duchamp London Online Gift Certificate can be ONLY redeemed online at www.duchamplondon.com and www.duchamplondonoutlet.com. It cannot be used in any Duchamp London stores, concessions or third party department stores or websites.
A Duchamp London Online Gift Certificate can be purchased in decimal amounts between £20.00 and £1000.00 (or between $20 and $1000).
The Online Gift Certificate is sent via email and contains a certificate code, balance, currency specification and expiry date.
The Duchamp London Online Gift Certificate is valid for 24 months and must be used by the date shown on the certificate. At the end of this period any unused balance will be forfeited.
Safekeeping and proper use of the Online Gift Certificate is a purchaser’s/recipient’s responsibility. Duchamp London cannot be held responsible for any Online Gift Certificate which is emailed to an incorrect address supplied by a purchaser, or which is lost, stolen or deleted. We cannot taken responsibility for Online Gift Certificates that cannot be delivered to the recipient’s email address because of spam filters, firewalls or other security measures.
A Duchamp London Online Gift Certificate cannot be refunded, exchanged for cash or vouchers.
Duchamp London reserves the right to cancel or refund an Online Gift Certificate if suspicions of misappropriated or fraudulent use arise. This complies with our order and payment ACCEPTANCE policy.
All refunds of Goods or Services purchased with Duchamp London Online Gift Certificate will be made in accordance with our refund policy. This does not affect your statutory rights.
Once you have made your choice and your order has been placed, you will be required to enter your payment details.
Your order will be acknowledged by an order confirmation email containing an order reference number. This information will be automatically emailed to the recipient address you have provided at the time of your order.
Unless you cancel your order in accordance with our CANCELLATION policy, acceptance of your order and completion of the contract between you and Duchamp London will take place when we dispatch the goods to you.
For the safeguard of both the consumers and Duchamp London we would be checking the information provided with our third party credit card gateway provider. This is solely aimed for a secure trading and to prevent any fraudulent or inappropriate use of personal and payment details.
Also, Duchamp London may request additional proofs of the purchaser’s personal details in order to verify their truthfulness.
We do reserve the right to not accept your order. Such non-acceptance may result from one or more of the following reasons:
-The product you order is out of stock;
-Our inability to obtain authorisation for your payment;
-We consider the payment information not to be fully genuine;
-We have identified a pricing or product description error.
Furthermore, we retain the express right not to process a transaction at any time at our sole discretion. In this event, we will not be liable to you or any third party by reason of our withdrawing any merchandise from Duchamp London Online Shop, whether or not such products have been sold.
Duchamp London reserves the right to follow legal procedures in order to guarantee a genuine and safe trading.
PAYMENT, SAFETY AND SECURITY
We do accept all major payment cards: Visa, Mastercard, Visa Debit, Mastercard Debit, Solo, Maestro UK, Maestro International, American Express, Visa Electron and Delta.
Payments will be debited and cleared from your account upon receipt of your Order by Duchamp London. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer.
If the issuer of your payment card refuses to authorise payment to Duchamp London, we will not be able to process your Order and a message will appear informing you that the transaction cannot be processed.
Duchamp London, together with its partners, takes all reasonable care to make its Online Shop as secure as they can.
To help ensure that your online shopping experience is safe, Duchamp London uses industry-standard Secure Socket Layer (SSL) technology, provided by GeoTrust. Users cannot inadvertently reveal personal information by using an unsecure connection.
Although we will employ all reasonable care to ensure that details of your order and payment are held secure, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from Duchamp London Online Shop.
Delivery times are subject to stock availability and to possible delays due to credit card authorisation, compliance with customs controls and any other factors outside our control.
We will only ship to countries featured in our shipping list and will not honour orders requiring delivery to any destination outside the countries listed. Once the order is placed, if the address entered does not correspond to the country selected, the order will be cancelled and a notification of cancellation will be sent to your nominated email address.
We do not ship to Russia and Nigeria. We strongly advise not to have orders delivered to P.O. Boxes or BFPO addresses as they may not be accepted by the courier we use.
Our chosen courier for delivery is DPD for domestic (DHL for International).
We will take all reasonable care to deliver your goods in the estimated time frame displayed here below:
UK (Mainland): 2 - 5 working days;
EU Countries and Channel islands: 3 – 7 working days;
Rest of the World: 7 – 10 working days.
Please note that during sale times and other busy periods delivery may take longer than expected. Duchamp London will strive to guarantee that all deliveries are honoured within 14 working days. Neither us nor our courier shall be under any liability for any delay or failure to deliver the Goods within the estimated time frame. Risk of loss and damage of Goods passes to you on the date and time of delivery of the Goods.
All deliveries require a signature. Please ensure somebody is in to sign for the goods. If you are not in to receive your order you can contact us to arrange a new delivery time. We cannot take responsibility for any delivery problems arising from incomplete or incorrect address details supplied by you.
If you prevent delivery of the goods by (for example) failing to supply the courier or your local customs tax office with necessary information or documentation, or failing to pay local customs, taxes or courier’s administration fees so your package is returned to us, any resulting return charge will be deducted from the amount refunded to you in respect to that order.
RETURNS AND CANCELLATIONS
Your satisfaction is our number one priority!
Please try to return the items in or with their original packaging with their labels intact. We also recommend that all returns are send via a recorded method. This will ensure a track of the returning merchandise. At any time, Duchamp London, we will be held responsible for any damage or loss of the returning items.
Refunds and exchanges must be made through the website. Please note that you have a legal obligation to take reasonable care of the items while they are in your possession, and if you fail to do so we may have a right to make a claim against you for compensation.
Duchamp London will not be responsible for covering the return charges unless the goods received are faulty or incorrectly supplied. In both cases the right items will be replaced without incurring in any additional charge.
Where promotional discounts are applied to orders, the discount will be applied to each item in the shopping bag. In the event of a return you will not be refunded the discounted proportion.
If it would be easier to exchange an unsuitable item to any of our stores and concessions, this can be possible as long as the goods have been purchased from any of our official stores or concessions or main website (www.duchamplondon.com). We do honour to accept the goods and exchange them within 28 days from the purchase date. Goods have to return in their original condition and with all labels attached. We will not exchange any item without a receipt or satisfactory proof of purchase.
Your rights under the Returns and Cancellations section are in addition ti the cancellation rights under the Consumer Protection (Distance Selling) Regulations 2000 as amended and superseded from time to time.. We recommend contacting us via email at firstname.lastname@example.org or by phone at 0333 939 8343 if you are planning to cancel your Order before the end of the statutory cancellation period 7 working days from day after you receive the Goods. We insist that all goods are returned unused, in their original packaging and with all original labels attached to the products.
Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged.
How and where to return for refund or exchange:
If you are not satisfied with the products received please return the unwanted goods within 28 days from delivery.
Please make sure that any items you would like to return are unused in their original packaging and in saleable conditions with any label still attached. Along with the goods make sure you will be sending the Return Form in your possession selecting the exchange or refund option. This is extremely important as it will help us in issuing a refund or exchange. Absence of such document may result in a delay or not applicability of the refund or exchange request. Also, we do recommend do fill in the Web Return Form in full, specifying the reason for the return. This will help us improving our business and give a better service.
Refunds are only credited on the same card used for paying the original order. Orders paid with a Duchamp London Online Gift Certificate will be refunded issuing a new gift certificate. A notification will be sent to the recipient’s address. We will refund the delivery costs only if a faulty or incorrect item has been provided by us.
Sometimes it will not be possible to stop an order from being dispatched. If your order has already been fully processed and dispatched please follow the returns policy.
